Alberto Policy Regarding Submissions, Postings and other Communications

All remarks, suggestions, ideas, graphics, videos, photographs and other information communicated by you to VO5 through any VO5 website (in each case, a "Submission") will forever be the property of VO5. You agree that by uploading a Submission to a VO5 website or by otherwise providing a Submission to VO5, you (1) transfer all of your rights in the Submission to VO5, (2) warrant to VO5 that the Submission is entirely your property or, if others have participated in creating the Submission, that everyone involved in creating such submission has agreed to the terms of this policy, (3) waive any and all other rights in the Submission, including but not limited to moral rights therein, if applicable, and (4) will be responsible for the content of the Submission including, without limitation, any obligation to compensate any other person or entity in respect of use of the Submission. You agree that you will indemnify, defend and hold VO5 harmless from and against any and all claims, law suits, losses, costs, expenses and liabilities it may suffer or incur arising from or in connection with the infringement or violation of any rights in a Submission claimed by anyone in all or part of such Submission. VO5 will not be required to treat any Submission as confidential. Without limitation, VO5 will have exclusive ownership of all present and future existing rights to the Submission of every kind and nature everywhere in the world and will be entitled to use the Submission for any commercial or other purpose whatsoever without compensation to you or any other person. VO5 may freely use any ideas in any Submission (including without limitation, any product or advertising ideas) without any liability to you or to any one else as a result of any such use. VO5 retains the right to review, edit or delete from the VO5 websites any Submission or any part of a Submission that VO5 in its sole discretion considers illegal, offensive, in violation of a third party right or otherwise inappropriate for use on a VO5 website.

Important: Do not upload any content unless it consists entirely of content you created yourself or content from others that they have given you clear, written permission to use. By uploading a video, you are representing to us that the content you are uploading (a) consists entirely of content you created yourself or content from others that they have given you clear, written permission to use and (b) does not violate the Terms of Use, including the other policies referred to in the Terms of Use. Your click also confirms your agreement to the content being used as described on this website.

Postings and Message Boards

VO5 requires that you do not post e-mails or submit to or publish through the VO5 websites any Submission (e.g., remarks, suggestions, ideas, graphics, videos, photographs and other information) or otherwise make available on a VO5 Website any content, or act in a way, which in our opinion:

(a) libels, defames, invades privacy, stalks, is obscene, pornographic, racist, abusive, harassing, threatening or offensive;
(b) seeks to exploit or harm children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;
(c) infringes any intellectual property or other right of any entity or person, including violating anyone's copyrights or trademarks or their rights of publicity and/or privacy;
(d) violates any law or may be considered to violate any law;
(e) that contains "insider" information or proprietary or confidential information or other information that is subject to any requirement of confidentiality under law or under any agreement such as an employment or a non-disclosure agreement);
(f) advocates or promotes illegal activity;
(g) impersonates or misrepresents your connection to any other entity or person or otherwise manipulates headers or identifiers to disguise the origin of the content;
(h) advertises any commercial endeavor (e.g., offering for sale products or services) or otherwise engages in any commercial activity (e.g., conducting raffles or contests, displaying sponsorship banners, and/or soliciting goods or services) except as specifically authorized on the relevant VO5 websites;
(i) solicits funds, advertisers or sponsors;
(j) includes programs which contain viruses, worms and/or "Trojan horses" or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications;
(k) disrupts the normal flow of dialogue, changes the rate at which a screen scrolls, or otherwise acts in a way which affects the ability of other people to engage in real time activities via a VO5 website;
(l) copies any other pages or images on a VO5 website except with appropriate authority;
(m) includes MP3 format files;
(n) amounts to a "pyramid" or similar scheme;
(o) amounts to "data warehousing" (i.e., using any web space made available to you as storage for large files which are only linked from other sites). You must provide a reasonable amount of content to accompany such material in order that at least some of the traffic to your site comes directly via VO5;
(p) disobeys any policy or regulations established from time to time regarding use of the VO5 websites or any networks connected to the VO5 websites;
(q) involves spoofing or otherwise impersonating any person or entity, including, without limitation, any other users or any of VO5's personnel, or falsely stating or otherwise misrepresenting your identity or affiliation in any way, or forging any TCP/IP packet header or any part of the header information in any e-mail or other posting; or
(r) contains links to other sites that contain the kind of content, which falls within the descriptions set out at (a) to (q) above.

Email and Other Communications

In connection with your use of the VO5 websites, you consent to VO5 recording any communication, electronic or otherwise, between you and VO5 and retaining any information and data you submit while using the VO5 websites, including archival copies of any Submission or other information that we remove from any VO5 website.

In using the VO5 websites, you may be permitted to communicate electronically with VO5 by sending electronic mail to VO5; however, you acknowledge and agree that only general information or inquiries may be submitted to VO5 via electronic mail and any other submissions or communications on or through the VO5 websites (e.g., the placement of orders) may be submitted only in accordance with the express instructions set forth on the VO5 websites for such submissions or communications. Please do not send any time-sensitive communications to VO5 as VO5 cannot be responsible for responding to any such communications.

Investigations

VO5 may seek to gather information from a user of any VO5 website who is suspected of violating this Agreement, and from any other user. VO5 may suspend any users whose conduct or postings are under investigation and may remove such material from its servers as it deems appropriate and without notice. If VO5 believes, in its sole discretion, that a violation of this Agreement has occurred, it may edit or modify any submission, posting or e-mails, remove the material permanently, cancel postings, warn users, suspend users and passwords, terminate accounts or take other corrective action it deems appropriate. VO5 will fully cooperate with any law enforcement authorities or court order requesting or directing VO5 to disclose the identity of anyone posting any e-mails, or publishing or otherwise making available any materials that are believed to violate this Agreement. YOU WAIVE AND HOLD HARMLESS VO5 FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY VO5 DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER VO5 OR LAW ENFORCEMENT AUTHORITIES.
